Terms of Service

The agreement between you and Timefolk.

Who we are and what we do

Timefolk is a curated marketplace where identity-verified adults offer approved social activities and knowledge-based sessions at their own prices and availability. In-person sessions take place at public venues for a fixed duration. Hosts are independent adults who set their own prices and availability; Timefolk provides discovery, scheduling, payment collection, identity verification and safety tools.

We are an intermediary. Hosts are independent people offering their own time; they are not our employees, agents, or contractors, and we do not supervise the sessions themselves.

We are not a dating or introductions service, an escort or companionship-for-intimacy service, a therapy or counselling service, a licensed tour operator, an employment agency, or a provider of medical, legal, financial or other regulated professional advice.

Who may use Timefolk

You must be at least 18, or older where your local law requires it.

You must complete identity verification, including a government identity document and a liveness check, before you can book or host.

One person may hold one account. Accounts are personal and may not be shared, sold, or transferred.

If we have permanently removed you before, you may not create a new account.

Bookings are between you and the other person

When a host accepts your request, a booking is formed between the two of you. We collect payment and hold the host's share until the session is complete.

A booking covers one named activity, at one named public venue, at one time, for a fixed length between 30 minutes and 6 hours.

Sessions do not extend automatically. Extra time must be bought inside the app before the booking ends, in 30-minute steps, and can never take a single session past 6 hours.

What you agree not to do

Break the Community Standards or the Safety Rules. Both form part of these terms.

Arrange payment outside Timefolk, or ask anyone to.

Use Timefolk to solicit or provide sexual services, or to pursue romance.

Scrape, enumerate, or otherwise systematically collect other people's information.

Misrepresent who you are, including with photographs that are not of you, are not recent, or are generated.

Suspension and removal

We may restrict, suspend, or permanently remove an account for breaches of these terms, for risks to other people, or where the law requires it.

Except where an immediate risk to safety or a legal obligation makes it impossible, we will tell you what we decided, why, and how to appeal.

You may close your account at any time from inside the app or at our web deletion page.

You meet at your own risk

Meeting another person carries risk that no platform can remove. Identity verification confirms that a person is who they say they are and is an adult; it does not predict behaviour, and it is not a background or criminal-record check unless we say so expressly for your country.

You decide whether to meet, where, and for how long. You are responsible for your own safety, belongings, travel, health, and for following local law and venue rules.

To the fullest extent permitted by law, you assume all risk arising from a session, including personal injury, property loss, and the conduct of any other person, and you release Timefolk, Inc. and its officers, employees and agents from claims arising out of any session or any interaction with another user.

What we do not provide

We are a technology intermediary. We do not provide, supervise, control, or guarantee any session, and we are not a party to the arrangement between guest and host.

We do not provide medical, legal, financial, psychological, travel, security, or professional advice of any kind. Nothing on the service is advice, and nothing said by a host is said on our behalf.

We do not provide insurance. Hosts and guests are responsible for their own insurance, including any public-liability or travel cover they consider appropriate.

We do not guarantee that the service will be available, uninterrupted, error-free, or secure, that content is accurate, or that any host or guest will attend.

Limitation of liability

To the fullest extent permitted by law, Timefolk, Inc. is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profit, revenue, data, goodwill or opportunity, however caused and under any theory of liability.

To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the service in any 12-month period is limited to the greater of the platform fees you paid us in that period and 100 US dollars (or the equivalent in your currency).

The service and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or under mandatory consumer-protection law in your country. Where such law gives you rights, these terms do not remove them.

Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless Timefolk, Inc., its affiliates, officers, employees and agents from any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of your use of the service, your sessions, your content, your breach of these terms or of any law, or your infringement of another person's rights.

Third-party services

Identity and phone verification are performed by Didit. Payments are processed by Stripe and email delivery by Resend, each under their own terms and privacy policies. We are not responsible for their acts or omissions beyond what the law requires.

Hosts who receive payouts also agree to the Stripe Connected Account Agreement, including the Stripe Terms of Service, which are incorporated by reference.

Sanctions, export controls and where we operate

You may not use the service if you are located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions, or if you are a person on a sanctions or denied-parties list. We refuse sign-ups and sign-ins from those jurisdictions.

Availability in any country does not mean the service complies with that country's law for your specific situation. You are responsible for checking that using the service, and hosting for payment, is lawful where you are.

Payouts are only possible where our payment provider supports them. Where they are not, you may browse and book but cannot receive host earnings until they become available.

Taxes

Hosts are responsible for all taxes, registrations, licences and permits that apply to income they earn through the service. We do not withhold or remit tax on a host's behalf unless the law requires us to, and we may report earnings to tax authorities where required (for example under DAC7 in the EU or equivalent regimes).

Disputes, governing law and arbitration

These terms are governed by the law of the State of Delaware, United States, without regard to conflict-of-law rules, except where the mandatory consumer law of your country of residence applies and gives you greater protection.

Before starting any formal proceeding, you agree to contact legal@jointimefolk.com and try in good faith to resolve the dispute with us for 60 days.

If we cannot resolve it, and to the extent permitted by the law that applies to you, the dispute will be resolved by binding individual arbitration under the rules of a recognised arbitration body seated in the State of Delaware, United States, and you and we each waive the right to a jury trial and to participate in a class, collective or representative action. Either of us may instead bring an individual claim in a small-claims court with jurisdiction.

Consumers in the European Union and United Kingdom may also use the courts of their home country and, in the EU, the European Commission's online dispute-resolution platform.

You may opt out of the arbitration clause by emailing legal@jointimefolk.com within 30 days of first accepting these terms.

General

These terms, together with the policies they refer to, are the entire agreement between you and us about the service. If any part is unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it.

You may not assign these terms. We may assign them to an affiliate or successor. Neither of us is liable for delay or failure caused by events beyond reasonable control.

We may communicate with you electronically, including by email and in-app notice, and you agree that electronic notices satisfy any legal requirement for written notice.

Changes

We will give notice of material changes before they take effect and ask you to accept the current version before you next book or host. For hosts, that notice is at least 30 days except where a change is required by law or addresses a safety or security risk.

If you do not agree to a change, stop using the service and delete your account; continued use after the effective date is acceptance.
